TERMS AND CONDITIONS OF USE


You use of this website (the “Site”) is subject to these terms and conditions (the “Terms”). By continuing to access this website you will be deemed to have accepted these Terms. In the event that you, at any time, do not accept or no longer accept any or all of these Terms you should immediately cease use of this Site.


This website is owned by Tourism Ireland Limited (“TOURISM IRELAND”) a company registered in Ireland with company number 336370 having its registered offices at 5th Floor, Bishop’s Square, Redmond’s Hill, Dublin 2.
TOURISM IRELAND may modify these Terms at any time without notice to you by posting revised Terms on the Site. Your continued use of the Site following the posting of revised Terms will mean that you accept and agree to such revised Terms.


Copyright Notice


Except for audiovisual content TOURISM IRELAND grants a royalty-free worldwide licence to each visitor to the Site to download and/or copy all images, story ideas, event information, itineraries and other content available on the Site (the “Content”) and to reproduce and/or edit such content in any and all media. 
In relation to the audiovisual content available on this Site please refer to the copyright information accompanying each piece of content for details. Most of the audiovisual content available on this Site is available for reproduction on a royalty-free, worldwide basis provided that it is used in the context of promoting tourism to Ireland.

You may not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other activity which infringes the rights of TOURISM IRELAND or others. Access to the Site
Whilst TOURISM IRELAND endeavours to ensure that this Site is normally available 24 hours a day, TOURISM IRELAND will not be liable if for any reason the Site is unavailable at any time or for any period.


Access to this Site may be suspended temporarily or permanently and without notice.

 

You acknowledge and agree that TOURISM IRELAND may stop making the Site available at any time without any liability to you.

If you register for the Press Room on the Site the following personal information may be collected and retained by TOURISM IRELAND: your name, email address, telephone number, the name of your company or organisation and your position within that company or organisation. Use of the Site and all of the information that TOURISM IRELAND collects from you is subject to TOURISM IRELAND’s Privacy Statement which may be viewed below.

TOURISM IRELAND is not responsible for any indirect, special, incidental, exemplary, incidental, punitive or consequential damages of any character including, without limitation, damages for loss of goodwill, work stoppage, computer virus, computer failure or malfunction, or any and all other commercial damages or losses arising from your use of this Site, even if TOURISM IRELAND has been advised of the possibility of such damages.


TOURISM IRELAND disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the Site. Suspension/Termination


TOURISM IRELAND has the right (but not the obligation) to suspend or terminate your use of the Site and/or to block your IP address immediately and without notice for any reason including, without limitation, if TOURISM IRELAND believes that you have acted inconsistently with these Terms or if TOURISM IRELAND believes that you have otherwise acted in a manner which is contrary to the spirit or intention of the Site or if TOURISM IRELAND otherwise suspects fraud or misuse of the Site or unlawful activity associated with your use of the Site.


Severability


If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable, such Term or Terms shall be severed and deleted from the clause concerned and the remaining Terms shall survive, remain in full force and effect and continue to be binding and enforceable.


Non-Waiver


TOURISM IRELAND’s rights and remedies shall not be diminished, waived or extinguished by the granting of any indulgence, forbearance or extension of time to you by TOURISM IRELAND nor by any failure of or delay by TOURISM IRELAND in asserting any such rights or remedies.


Entire Agreement


These Terms constitute the entire agreement between you and TOURISM IRELAND with regard to your use of the Site.


Law and Jurisdiction
Use of this Site is subject to existing laws and legal process. Nothing contained in these Terms shall limit TOURISM IRELAND’s right to comply with governmental, court, and law-enforcement requests or requirements relating to your use of this Site.


These terms shall be governed by and construed in accordance with the laws of Ireland and you irrevocably agree to bring any action to enforce these Terms before a court of competent jurisdiction in Ireland.

TOURISM IRELAND respects your privacy. This Privacy Statement explains how any personal information you provide on the Site is processed and used by us. This Privacy Statement is designed to protect you, our users, by informing you what personal information is collected, what we do with that information, with whom we share it, and the methods we use to collect it.

TOURISM IRELAND is proudly committed to complying with the Data Protection Acts of 1988 and 2003 and any traditional and digital marketing efforts we undertake adhere strictly to the provisions of those Acts.


Information we collect


Simply put, our function is to facilitate your efforts to find content and news on Irish tourism so the collection of personal information from you is limited and always voluntary. As a user of the Site, you may opt-in to receive information from us, in which case we will require certain personal data from you. This will include your name and email address, and we may also ask for your telephone number the name of your company or organisation and your position within that company or organisation. In all cases, you can be assured that we will only seek the most basic details needed to get the information you requested to you in a timely fashion.


Use of your information by third parties


TOURISM IRELAND does not attempt to collect further data without user consent that enables personally identifiable profiling of our users. We collect and collate generic information on all our site traffic that is only ever represented in aggregate format.


Retention


No personal information will be retained for longer than is necessary.


Disclosure


TOURISM IRELAND does not sell or pass on your personal details to third parties without your consent, except in the following, highly unlikely, instances: 
• where it is required by applicable law or pursuant to a court or similar order
• where it is required urgently to prevent serious loss or damage to property of TOURISM IRELAND

Analysis of click trails


On TOURISM IRELAND websites, IP addresses (the Internet address of a computer) are logged to track a user’s session while the user remains anonymous. We analyse this data for certain trends and statistics, such as which parts of our site users are visiting and how long they spend there. We do not link your IP addresses to anything personally identifiable to you.


Cookies

A cookie is a text-only file that is placed on your computer by another computer on the internet to enable that computer to know when you are visiting a particular web site.


Cookies enable us to monitor the number of people visiting our site and to determine the country of origin of specific users. Conditions of use and revisions


TOURISM IRELAND’s function may change in the future and TOURISM IRELAND reserves the right to amend this Privacy Statement at our discretion. Any modifications that do occur will be effective upon such time as the amendments are posted on the Site. Users shall be deemed to accept the modified statement by continuing to access the Site on or after the date of modification.

Access, correction or removal of personal data


You have the right to be given a copy of information held by us about you. TOURISM IRELAND may charge a fee for this which will not exceed €6.35. The requested information will be provided to you within 40 calendar days of the receipt of a valid request in writing.
You have the right to have any inaccuracies in the information held by TOURISM IRELAND about you corrected, if inaccurate, or erased, if we do not have a legitimate reason for retaining that information. We will accede to any such valid requests within 40 calendar days of the receipt of a valid request in writing.


TOURISM IRELAND reserves the right to request you to provide additional information in order to enable us to identify your personal data and/or to verify your identity.


Governing Law and Jurisdiction


This Privacy Statement and all issues regarding the Site are governed exclusively by Irish law and are subject to the exclusive jurisdiction of the Irish courts.
